Excessive force used by bailiff?
Woman files complaint against court officer

An El Dorado Hills woman filed a compliant against an El Dorado County court bailiff claiming he used excessive force in escorting her from a courtroom.

Penny Arnold filed a complaint with the El Dorado County Sheriff’s Department against bailiff Ken Brown earlier this month.

According to the complaint she is asking for more than $10,000 in damages.

Arnold says she was asked to leave a Family Law hearing by Judge Daniel Proud on Oct. 6.

“You’d have to ask the judge why he asked me to leave,” Arnold said. “He wouldn’t allow me to present evidence regarding a family law case.”

Arnold did not elaborate.

Ken Brown was the bailiff tasked with escorting Arnold, who says she was using crutches at the time and had a cast on her leg from injuries she reportedly sustained in a car accident.

According to medical records, provided to the Telegraph by Arnold, she suffered back and neck strain along with a sprain to her ankle. She was to wear a splint and use crutches as needed, according to the medical records dated Oct. 3.

“(Brown) took my right arm as my right crutch went flying in the air, and pulled it with such excessive force behind my back up towards my neck, spin, right shoulder area as my neck, spine and right shoulder were cracking,” the complaint states.

Arnold was escorted out of the courtroom and eventually handcuffed, she said.

She said that Brown then told her she was “under arrest.”

There are no records to indicate that Arnold was actually placed under arrest.

Arnold said she was taken by ambulance to Marshall Medical Center in Placerville for treatment of injuries she allegedly sustained at the hands of Brown.

Calls to the El Dorado County Superior Court and the El Dorado County Sheriff’s Office were not returned as of press time.
